This notice should be read by ALL individuals whom we interact with online, face-to-face, or through phone call. This includes the following:

  • Clients: refers to anyone who has an account, transacts, or trades with MyTrade PH and its platforms.
  • Non-clients: refers to past or prospect clients who have inquired, transacted, and traded with MyTrade PH. This includes all free trial accounts, registrants, and withdrawn accounts.

MyTrade PH collects your information to validate your data submitted, fulfill contractual obligations, process the account transactions, and provide the best customer experience. All the client’s information/ data shall be processed fairly and lawfully for the following reasons:

  • You have given consent to process your data for a specific purpose (e.g. account opening)
  • You have declared that you allow MyTrade PH to process the information that you have provided for any legitimate purpose which must not be contrary to law, morals, or public policy
  • You have signed a contract and/or a document with MyTrade PH
  • You allow MyTrade PH to comply with legal requirements—the processing is necessary for MyTrade PH to comply with the law (including rules and regulations, policies and mandates prescribed by the Securities and Exchange Commission (“SEC”), and other relevant regulators

Know-Your-Customer (KYC) or identification data
Collection of information upon sign up, account opening, and/or registering to our products or services with your full legal name, present address, permanent address, date of birth, civil status, gender, home number, mobile number, email address, company name, job position, office number, tax identification number, government-issued identification numbers, source of funds, gross annual income, and any information needed in regulation with BSP

Transactional data
Linkable information to your data such as (1) bank account number, deposits, withdrawals, such other transfers to or from your account (2) information shared when you reach MyTrade through other channels such as Facebook Messenger, contact centers, and / or company visit (3) any customer payment, withdrawal, and transactions you have with MyTrade PH

Financial data
Any information about the value of your portfolio, deposits / withdrawals made in your account, and other accounts related to you

Relevant information data of individuals
Upon your authorization, we may collect information about family members, beneficiaries, attorneys, attorneys-in-fact, shareholders, authorized signatories, other security and other individuals

Data Profiling
To evaluate certain aspects in processing your information, we will analyze, predict, and assess an individual’s personal preferences, economic standing, interests, behavior, location, and health.

Customer Engagement

  1.  MyTrade PH will use your information to communicate with you about your account.
  2. MyTrade PH may send you email updates, phone calls, text messages, or newsletters about account-related concerns, stock market updates, and MyTrade PH services enhancements & security reminders
  3. You may opt out to not receive these updates or choose another means of communication.
  4. You may opt to fill out the basic information only.


Marketing

  1. MyTrade PH may use your information to send out campaigns of products, newsletters, advisory, or any form of announcement.
  2. To establish a rapport and a more personalized relationship with you by providing exclusive information and stock market updates.
  3. You have the option to unsubscribe or withdraw your consent anytime from the campaigns or any personalized newsletters.
  4. You have the right to opt out in participating in MyTrade PH website campaigns and social media promotions such as reposting of any MyTrade-related content that you posted in any digital platform.


Compliance to SEC, PSE, AMLC, CMIC, and MyTrade PH Regulations

  1. MyTrade PH may use your information to evaluate your eligibility in availing the products.
  2. MyTrade PH will process your information in compliance with SEC, PSE, AMLC, CMIC, and the company’s regulations.

We only share or disclose your information with MyTrade PH employees, authorized representatives, agents, consultants, and service providers.

MyTrade PH will keep all types of information, documents, and records as long as it is necessary for the processing. ALL data and information will be stored in a secured system environment.

  • We will retain your information in accordance with SEC, PSE, AMLC, CMIC, and DPA’s regulation and for legitimate documentation purposes.
  • Accounts that have closed, been terminated, or withdrawn will be tagged as close accounts and will be stored in a secured system if in case these accounts decide to be active again.
  • MyTrade PH shall retain for the establishment, exercise, or defense legal claims.

When MyTrade PH processes your information and documents, you are entitled and  have certain rights under DPA which include:

  1. Right to be Informed. You have the right to object or demand the details as to how your personal data is being processed or have been processed by the MyTrade PH, including the existence of automated decision-making and profiling systems.
  2. Right to Access. Upon written request, you may demand reasonable access to your personal data, which may include the contents of your processed information, the manner of processing, sources where they were obtained, recipients and reason of disclosure. You may also request to remove your information from our database upon request.
  3. Right to Rectify. You may dispute inaccuracy or error in your personal data in the MyTrade PH database through our client experience team.
  4. Right to Object. If you decide to cancel the process or withhold consent, MyTrade PH will no longer process any of your information.
  5. Right to Erasure or Blocking. Based on reasonable grounds, you have the right to suspend, withdraw or order blocking, removal or destruction of your personal data from the MyTrade PH’s secured system, without prejudice to MyTrade PH continuous processing for commercial, operational, legal, and regulatory purposes.
  6. Right to Data Portability. You have the right to obtain from MyTrade PH your personal data in an electronic or structured format that is commonly used, subject to the Bank’s internal procedures.
  7. Right to Damages. You have the right to be indemnified for any damages sustained due to such violation of your right to privacy through inaccurate, false, unlawfully obtained or unauthorized use of your information.
  8. Right to File a Complaint. If you feel that your information has been misused, maliciously disclosed, or improperly disposed, or that any of your data privacy rights have been violated, you have a right to file a complaint with our Compliance Officer  and/or with the NPC through www.privacy.gov.ph.

MyTrade PH may revise or update the Privacy Policy and you will be informed through phone call, newsletter, or social media updates of any changes or revisions.
